In this text, the author examines the basic principles of tortious liability in the context of the countries and territories of the South Pacific Region. Torts of strict liability are studied, including trespass, escape of dangerous things, nuisance, conversion and defamation. Torts based on intention, recklessness or negligence are discussed, as are the remedies available in tortious actions. Attention is given to the relevance of custom to tortious liability. Specific reference is made to the rules and procedures as they are found in the region's jurisdictions and authority, both statute and judge-made, from other influential countries is included.
